These files are the interactive sets of Family Court forms that Judge Smith created from the forms that have been approved by the Missouri Supreme Court:

Dissolution of Marriage Forms Package (Divorce) These are the forms to use if you want to file a dissolution of marriage (divorce) in the State of Missouri. The use of these forms is required by Missouri Supreme Court Rule 88.09.

Motion to Modify Child Custody Forms Package These are the forms to use if you want to change the custody judgment for your children. As a part of the change of custody, you may also request a change of child support. This case must be filed in the county that entered the custody judgment. The use of these forms is required by Missouri Supreme Court Rule 88.09.

Motion to Modify Child Support Forms Package These are the forms to use if you want to change the child support that you are currently paying pursuant to a court judgment. This case must be filed in the county that entered the support judgment. The use of these forms is required by Missouri Supreme Court Rule 88.09.

Petition for Custody Forms Package (for use when paternity has already been established) These are the forms to use if you want to get a custody judgment and paternity has already been established. If the birth certificate contains the names of the biological parents of the child, then probably paternity has already been established. Many times paternity is established by Missouri Family Support Division as part of an administrative hearing. If paternity was previousl established by a court proceeding such as a paternity case, then you should use the Motion to Modify Child Custody Forms Package above.  The use of these forms is required by Missouri Supreme Court Rule 88.09.

Form 14 Child Support Calculation (Updated July 11, 2013) In Missouri, child support is calculated on Form 14. This is the interactive version of Form 14. It is not a substitute for a qualified attorney, but it does correctly calculate support if you enter the correct information. Form 14 is included in CAFC501 – Parenting Plan.

Father’s Petition for Declaration of Paternity Forms Package These are the forms to use if you are a man and you want a court order stating that you are the LEGAL father of a child. As part of a paternity proceeding, you may also request custody and support orders. The court will require that a guardian ad litem be appointed to represent the minor children.  The use of these forms is required by Missouri Supreme Court Rule 88.09.

Mother’s Petition for Declaration of Paternity Forms Package These are the forms to use if you are the mother of a child and you want a court order stating that a man is the LEGAL father of the child. As part of a paternity proceeding, you may also request custody and support orders. You will be acting as the “next friend” for the child.  The use of these forms is required by Missouri Supreme Court Rule 88.09.

Presumed Father’s Petition for Declaration of Non-Paternity Forms Package These are the forms to use if you are the presumed father of a child but you are not the biological father of the child and you want a judgment stating the you are not the LEGAL father of the child. A presumed father is generally a man who was married to the mother of a child that was born during the marriage or within 300 days after the end of the marriage. The court will require that a guardian ad litem be appointed to represent the minor children.  The use of these forms is required by Missouri Supreme Court Rule 88.09.

CAFC501 – Parenting Plan (Interactive Version) This form sets out the complete support and custody arrangements for your children. It is part of most of the form packages.  The use of these forms is required by Missouri Supreme Court Rule 88.09.

Affidavit Acknowledging Paternity This may be an alternative to filing a paternity case. If the only thing you want is to add the biological father’s name to the birth certificate, then you may use this form. The man then becomes the LEGAL father of the child with all of the rights and responsibilities that arise out of the parent/child relationship. A required statement is read to you when this form opens, so if you are in a library or somewhere that you don’t want other people to hear this notice, you should turn the volume down before you open this form. You must listen to this statement before you complete this form.

Father Petition to Set Aside Judgment of Paternity (coming soon)
